Notice To California Consumers

THIS SECTION APPLIES TO YOU ONLY IF YOU ARE A RESIDENT OF CALIFORNIA

If you are a resident of California, you may be entitled to certain rights under the California Consumer Privacy Act of 2018 (“CCPA”).

Under the CCPA and its attendant proposed regulations, California residents have (a) the right to request access to the personal information collected in the previous 12 months; (b) the right to request deletion of personal information; and (c) the right to opt out of the “sale”, as defined under the CCPA, of personal information. These rights are subject to certain exemptions and exceptions as well as certain steps we must take to verify your identity. If we cannot verify your identity, we cannot honor your request.

 

Right to Know and Delete

When exercising your right to know, you have the right to request the following from us:

  • The categories of personal information we collect about you;
  • The categories of sources from which we collect your personal information;
  • The business or commercial purpose for collecting your personal information;
  • The categories of third parties with whom we share your personal information; and
  • The specific pieces of personal information we have collected about you in the previous 12 months.

When exercising your right to deletion please note that cancellation and deletion of your account will result in us and you being unable to access your account.

 

How to Exercise Your Rights to Know and to Delete

To exercise your rights to know and/or to delete described above, please submit a verifiable consumer request to us by either:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide two or more data points that allows us to reasonably verify you are the person about whom we collected Personal Information or your authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with your Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We do not generally sell information as the term “sell” is traditionally understood. However, if and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for certain targeted advertising, California Residents may indicate your election here and we will comply with applicable law as to such activity.

If you elect to exercise any of your rights under CCPA, we will not deny services, provide a different price or rate for our services, or provide a different level of service to you because you exercised such rights.

 

Response Timing and Format

We will confirm receipt of your verifiable consumer request within ten (10) business days and provide you with information about how we will process the request, describing our verification process and when you should expect a response. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period immediately preceding our receipt of your verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is useable and should allow you to transmit the information from one entity to another entity.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, if you provide us with Personal Information in order for us to fulfill your product order
  • To provide you with information, products or services that you request from us
  • To provide you with email alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice

 

Sharing Personal Information

We may disclose your Personal Information to a third party for a business and/or commercial purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

Additional Information for California Residents

Please note the following:

  • Users can visit the Site anonymously without providing their Personal Information, but we may collect Personal Information, such as IP addressed, automatically through the use of cookies or other tracking technologies; 
  • We will add a link to this Privacy Notice on our home page, or at a minimum, on the first significant page after entering the Site;
  • Our Privacy Policy link includes the word “Privacy” and can be easily be found on the page specified above;
  • Users will be notified of any privacy policy changes on our Privacy Policy page;
  • Users are able to change their Personal Information by emailing us, by calling us, or updating their Personal Information in their online accounts with us;
  • Some Internet browsers include the ability to transmit “Do Not Track” signals that give you control over the collection and use of web browsing information. Because uniform standards for “Do Not Track” signals have not yet been adopted, we do not process or respond to such signals in users’ web browsers at this time; and
  • We allow the collection of users’ behavioral tracking by third parties. We do not authorize the collection of Personal Information on the Sites by third parties (check this – if analytics companies collect IP addresses, this is considered personal information under CCPA)
